This year’s National Risk Retention Association (NRRA) National Conference in Chicago offered several sessions focused on disruptive innovation’s impact on the rapidly changing face of risk. The keynote presentation,
The Reality Trap
, was a thought-provoking exploration of how expanding one’s perspective can equip people to better embrace change. The presenter challenged audience members’ preconceived notions about generational differences and suggested that we simply cannot learn new skills quickly enough to keep up with the ever-accelerating pace of change.

In the late 1990s, staff at Colorado Open Lands, a nonprofit land trust that exists to protect Colorado’s treasured land and water resources, started wondering how it would handleenforcement actions on its easements. The answer ultimately led to the creation of a unique insurance company that helps land trusts protect the public benefit of conserved lands forever and covers land trusts’ public liability for lasting conservation.

Over the last thirty years, several ill-fated attempts have been made to expand the Liability Risk Retention Act (LRRA). A number of these attempts have focused on permitting risk retention groups (RRGs) to provide property insurance coverage, typically focusing on under-served property markets such as coastal or urban areas. A new bipartisan proposal, H.R. 3794, introduced by U.S. Rep. Dennis Ross, R-Florida, may present a thoughtful, measured toe hold for RRGs to expand into property insurance.
